1. The Terms

By using this website (scapegracedistillery.com.au), you agree to be bound by these Terms and Conditions (Terms). These Terms apply to all users of the website and to all purchases of goods and services from Scapegrace Australia Pty Ltd (Liquor Licence No: LIQP770018387) (we/us). If you do not accept these Terms, please refrain from using the website.

We may update these Terms from time to time. Changes take effect immediately upon publication. Continued use of the website confirms your acceptance of the updated Terms. 

All goods and services are supplied strictly on these Terms, unless we have agreed in writing to a variation.

Additional terms may apply to specific promotions, offers, or sections of the website.

2. Your Information & Privacy

To purchase products, you must provide personal information including your name, delivery address, phone number, and email address.

We collect, store, and use your data in accordance with our Privacy Policy. By providing your personal information, you consent to its use for order fulfilment, customer service, and, if opted in, marketing communications.

We may share your data with trusted third parties such as payment processors and delivery providers for the sole purpose of completing your transaction.

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You may request access to, correction of, or deletion of your personal information by contacting us at: hello@scapegracedistillery.com.au

3. Orders & Payment

• All prices are in Australian Dollars (AUD) and include GST, unless otherwise stated.
• Prices may change without notice prior to order confirmation.
• Ownership transfers upon full payment. Orders are not binding until accepted by us.

By placing an order, you confirm that:
You are 18 years of age or older.
The recipient is also over 18 years old.
You are the authorised holder of the payment method used.

All orders are subject to payment verification and approval. We may cancel orders in cases of suspected fraud or unauthorised use.

4. Delivery

Scapegrace Australia operates under NSW Packaged Liquor Licence – Delivery Only (LIQP770018387). In accordance with NSW liquor legislation:

• Same-day delivery is not permitted.
• Deliveries may only occur between 10:00 AM and 12:00 midnight (inclusive).
• No deliveries are permitted on Good Friday or Christmas Day.
• Alcohol must only be delivered to persons aged 18 years or older.
• If the recipient appears to be under 25, ID must be sighted and verified by the delivery driver.
• If no one aged 18+ is present to receive the delivery, the order will not be left unattended and will be returned to the depot or reattempted as per the carrier’s policy.

5. Shipping Terms

• Shipping fees are shown at checkout.
• We cannot deliver to PO Boxes.
• A person aged 18 or over must receive and sign for the delivery.
• If incorrect or out-of-date details are provided, we are not liable for misdelivery.
• Risk and ownership of goods transfer to you upon dispatch.

6. Dispatch & Timing

Orders are shipped from our Australian warehouse based in Melbourne, using Australian Post.

• Victoria (VIC) 2-4 Business Days
• All other states: 3-6 Business Days Australia Wide

We use all reasonable efforts to deliver on time, but delays may occur due to factors outside our control. 

We may refuse delivery if the recipient appears underage or if delivery is otherwise deemed inappropriate. In such cases, we will attempt redelivery or issue a refund.

5. Northern Territory Orders

If ordering to a Northern Territory address, you acknowledge that pricing may be adjusted to comply with minimum alcohol pricing regulations under the Liquor Amendment (Minimum Pricing) Act 2018 (NT).

6. Returns & Refunds

• Faulty or damaged items: notify us as soon as possible or within 7 days at hello@scapegracedistillery.com.au. Supporting evidence may be required. If accepted, we may cover return shipping.
• Refunds will be processed to your original payment method and may take up to 10 business days.
• Change-of-mind returns: accepted within 30 days if unopened and in saleable condition. Return shipping is at your cost.

We may cancel orders prior to dispatch due to stock issues, pricing errors, or other unforeseen circumstances. If so, we’ll issue a full refund. Please see our Returns & Refunds Policy for more details. 

7. Gift Vouchers

Scapegrace gift vouchers:

• Are valid for 3 years from date of issue
• Redeemable only on this website
• Not transferable, refundable, or redeemable for cash
• Not reissued if lost, stolen, or expired
• May not be used for commercial promotions without written consent

8. Competitions

By entering a competition or giveaway, you agree to be added to our mailing list (you may unsubscribe at any time).

We will never request sensitive personal information as part of a promotion. If a prize-related event is cancelled, we are not liable for replacement unless required by law.

9. Account Registration

If you create an account:

• You are responsible for maintaining confidentiality of your login
• Notify us immediately of any unauthorised use
• You may request account deactivation and data deletion in accordance with our Privacy Policy

We reserve the right to suspend or delete accounts in cases of misuse or policy violations.

10. Website Accuracy & Product Images

Product details, images, and pricing may change without notice. We do not guarantee the accuracy or completeness of content on the website and are not responsible for typographical errors or outdated information.

Images are for illustrative purposes only and actual packaging or product appearance may vary.

11. Intellectual Property

All content on this site - text, images, logos, and graphics - is the property of Scapegrace Australia Pty Ltd or its licensors and is protected by copyright and trademark laws. You may not copy, modify, distribute, or use any content without our prior written permission.

• Our liability is limited to product replacement, supply of equivalent goods, or a refund

You agree to indemnify and hold harmless Scapegrace Australia Pty Ltd, its directors, employees, and agents from any third-party claims, liabilities, or expenses arising from your breach of these Terms.

17. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from or relating to this website or your use of our services.
